Update again this past Friday they were supposed to deliver my van and failed. It’s at dealer with all my shelves and ladder rack etc from old truck. I showed up Friday with title for old one and cash to pay difference the service manager met me with indifference and excuses and I’ve had about enough of them. Need less to say I cussed loudly asking them if they were to stupid to be able to sell it, I was asked to leave after I loudly proclaimed it’s a wonder you **** morons are still in business. Lol got a call Friday afternoon with more excuses, I told them I take delivery Monday or we are taking $100 a day off what I pay them, if they don’t like I’ll restart social media campaigns and sue them.

It gets even more phaced, they called me yesterday and lemme know they never agreed (In writing) to the settlement deal and I can have the van for $10200 and they may be able to get it done this week :o

Sue. And go for the moon when you do.

Get you a used 3500 Chevy Van from the 90's in the meantime. That'll run without much bs.

At this point all I can sue for is breach of warranty contract. I can’t even really sue for the loss of use, we made January a record month with only one van, granted we double staffed it and I brought them everything they needed with my pickup and we worked extremely long days but I can’t show a loss because I made it work. By February I’d bought another van to use so again my numbers don’t show losses even though I’ve turned a lot of calls down I would’ve used it for!

You could be right. Not sure though. Check with a good/crooked attorney. "Loss of use" may be open to interpretation. You "making it work" and the things you had to do for that show loss of use in my interpretation. The cost of the other van also adds into the loss of use. Etc. And don't forget the Lemon Laws if they apply.

Well I get to eat more of the crap sandwich :sick1 :sick1

After discussing with my attorney, we don’t have much of a case as their warranty pretty much excludes any way they might screw up. Lost time or profits is specifically excluded.
Pretty much they are guilty of terrible service and that isn’t against statutes that we can point to or expect to win from. The one statute we can point to is breach of contract due to time to fix but it’s to open ended and time I pay attorney I can’t expect to win much.

So I pulled the trigger on the one for $10200
